General Release

Aerial or fitness products or installation mounting hardware (Equipment) sold and/or installed by H. A. WONG LLC DBA The Yoga Studio (H.A. Wong LLC) are intended to be used by those who are trained and experienced in the use, inspection and maintenance of the Equipment. Using the Equipment can be extremely hazardous. The Equipment and installation support structure can change over time from use and deterioration. The Equipment, installation mounting, and the support structure should be inspected before each use. Proper training, knowledge and good judgement with the Equipment and the installation are required before using the Equipment.

LIMITS OF LIABILITY:
H.A. Wong LLC can not inspect or ensure the Equipment and the support structure are properly inspected and maintained before and after each use, therefore |not responsible for any damages or injuries resulting from abuse, proper or improper use of the Equipment.

RESPONSIBILITIES OF THE USER:
The responsibilities of the user of the Equipment includes but not limited to:

  • inspection of the Equipment immediately after receipt and/or installation
  • inspection of the Equipment and support structure before and after each use
  • seek professional training on the use, inspection and the ongoing maintenance of the Equipment
  • seek professional service for the inspection and maintenance of the Equipment at least two times a year
  • obtain proper training by a professional in the use of the Equipment; not alter the Equipment or installation configuration in any way
  • not exceeding the limitations of the user’s skill of the Equipment; and use highest safety precautions



    • ACCEPTANCE OF TERMS OF USE:
    By accepting the products or services sold, the purchaser/user hereby release and discharge H.A. Wong LLC and its successors, any past, present, or future agents, directors, employees, officers, shareholders, their respective heirs, estates, personal representatives, from any claim, cause of action, demand, action or right of action, which he, she or it might have with respect to, in any way connected with or arising out of any product or installation from H.A. Wong LLC.

    RELEASE OF LIABILITIES:
    The purchaser/user of Equipment sold or installed by H.A. Wong LLC does hereby release and discharge H.A. Wong LLC and its successors, any past, present, or future agents, directors, employees, officers, shareholders, their respective heirs, estates, personal representatives, from any claim, cause of action, demand, action or right of action, which he, she or it might have with respect to, in any way connected with or arising out of any Equipment or installation from H.A. Wong LLC. The purchaser/user elects to waive any right that he, she or it might have to dispute the scope of the foregoing release on the grounds of any statutory or judicial provision of any jurisdiction. The purchaser or recipient in any manner agrees that the release contained in this paragraph shall be construed as broadly as the law permits.

    RETURN POLICY
    ALL Aerial equipment are non-returnable and non-refundable.
